Sales and Use Tax in New York

December 11

Gain a better understanding of New York sales and use tax obligations.

Sales tax is a particularly confusing tax. Whether a transaction is taxable or exempt often hinges on miniscule factual distinctions. Moreover, compliance is notoriously difficult, especially today given the use of the internet and a vendor's ability to sell to customers all over the country. Vendors are often unsure of whether their transactions are subject to tax, or even which states get to tax the transactions at issue. This topic will provide you with a general overview of New York's sales tax, including a review of the transactions that are taxable and exempt in New York State. The material will provide a more detailed review of certain industries and transactions that have special tax compliance obligations. Finally, the topic will explain how New York's Tax Department finds businesses to audit and will walk through an audit from the first audit notification letter to potentially appealing an adverse audit determination.

Learning Objectives

- You will be able to describe the audit process.

- You will be able to identify transactions that are either taxable or exempt under New York's Sales Tax Law.

- You will be able to recognize when a business has a sales tax filing obligation in New York and how transactions are sourced for sales tax purposes.

- You will be able to discuss the sales tax rules as they apply to specific industries in New York.
