Ethical Issues in Construction Law

Gain an understanding of ethical standards, challenges, and obligations commonly encountered while representing clients in the construction industry.

Construction projects involve numerous parties from owners, construction managers, contractors, subcontractors, suppliers and design professionals. Moreover, labor unions, government entities and other interested parties are also involved. Attorneys often face ethical questions when they represent one or more of these parties. What ethical obligations must be considered when deciding to represent a client on a construction dispute? What further ethical obligations must be considered when a litigation proceeds to include additional parties and one of these additional parties is a current or former client? What responsibilities does an attorney have in connection with the False Claims Act, verifying mechanic's liens and other construction related documents for a client? This topic will present guidelines for this often intricate and challenging field of law.

The rules of professional conduct have their own unique application to common issues involving construction law. Additionally, professional conflicts can arise in unsuspecting ways in the construction setting. This material is designed to provide an overview of ethical standards and obligations commonly encountered while engaged in representing clients in the construction industry.
